TERMS OF SERVICE

The site ( www.maisonafro.com ) (the “Site”) is published by Maison Afro.

 

The Site offers online sales of beauty and hair care products and accessories.

 

The version currently online of these general conditions of use (the "General Conditions of Use" or "CGU") is the only one opposable for the entire duration of use of the Site and this, until a new version replaces it.

 

PREAMBLE: Definitions

 

User: designates any natural or legal person consulting the Site.

 

Customer Account: refers to the space accessible from the Site, which any User, professional or individual, must create to be able to order Products on the Site.

 

Customer: refers to any person who has created a Customer Account and placed an order for a Product on the Site.

 

Offer: designates all the visual, textual and sound elements, constituting the sheets of the Products marketed by Maison Afro on the Site.

 

Product: refers to any merchandise offered for sale on the Site by Maison Afro.

 

Services: refers to all the services offered by Maison Afro, namely access to the Site and the purchase of Products.

 

 

  • Access to the site

 

Any User of the Site, declares by accessing the Site, to have read these General Conditions of Use and expressly accept them without reservation. These T&Cs are binding on any User of the Site in any capacity whatsoever.

 

  • Placing an order

 

Placing an order implies the creation of a Customer Account and is exclusively reserved for adults or persons, natural or legal, legally capable of signing a contract.

 

 

  • The rules of good conduct to be respected

 

Users undertake to comply with these General Conditions of Use for the entire duration of use of the Services as well as all applicable laws.  

 

Rule n°1: respect for content and intellectual property rights

 

Each User must respect all the elements forming an integral part of our Services, namely any text, graphic, image, music, video or other element likely to be put online by a User or by Maison Afro and accessible by other Users (the “Contents”).

This Content may be protected by intellectual property rights (in particular copyright, trademark law, patent law), as provided for by the Intellectual Property Code and international treaties ("Intellectual Property") that you undertake to respect.

 

Rule n°2: respect for the rights of third parties

 

In particular, it is prohibited, without this list being exhaustive, to:

  • defame, insult, harass, stalk other Users or representatives of Maison Afro

  • impersonate other Users or third parties

  • publish false information, in particular by creating false accounts

  • prevent other Users from accessing or using the Site

  • promote any religion or religious activity

  • offer any commercial promotion or preferential rates from any other company or service

 

Rule n°3: respect for safety

 

In particular, it is prohibited, without this list being exhaustive, to:

  • transmit viruses, worms, defects, Trojan horses or any other element of a destructive nature or likely to steal or reveal another user's data

  • promote or provide instruction on illegal activities

  • promote physical or moral violence against a group or a person

  • use a robot or any other device to scrape or index all or part of the Site or to collect information about Users for unauthorized purposes

 

In the event of non-compliance with these rules by a User, Maison Afro reserves the right to apply sanctions. These penalties will be decided on a case-by-case basis depending on the situation and the seriousness of the facts alleged against the User.

Maison Afro may in particular:

  • restrict or suspend the User's access to the Services

  • temporarily or permanently ban him from accessing the Services

Maison Afro may also take legal action to engage the civil or criminal liability of the User when his behavior affects the services, in order to be compensated.

 

  • Intellectual property

 

All Intellectual Property rights relating to the structure and content of any kind whatsoever of the Site (in particular images, sounds, videos, photographs, texts, animated images, logos, data) are the exclusive property of Maison Afro . These elements of intellectual property are made available to Users, exclusively in the context of the use of the Site in accordance with these T&Cs.

 

Any reproduction, representation, use or adaptation in any form whatsoever, of all or part of the elements of the Site, is prohibited and constitutes a violation of copyright.

Any reproduction, even partial, without the prior authorization of Maison Afro is prohibited.

 

Any User undertakes in particular not to:

 

  • Extract for commercial or non-commercial purposes, all or part of the Offers published on the Site and present on any other medium;

 

  • Reproduce on any other medium, for commercial purposes or not, all or part of the Offers published on the Site  and present on any other medium.

 

Any reproduction, representation, publication, transmission, use, modification or extraction of all or part of the Offers published by Maison Afro is prohibited. These illegal acts engage the responsibility of their authors and justify the introduction of legal proceedings against them.

 

The content of the Offers published by Maison Afro remains its exclusive property.

 

 

  • Personal data

 

The personal data collected on the Site are the following identity data, contact data, purchase data, browsing data.

  • Creation of Customer Account

                                                      

The creation of a Customer Account can be done by entering an email address or by Google or Facebook authentication. In the latter case and by using such a feature, Maison Afro will have access to the information from the User's Facebook or Google account necessary for connection. Nevertheless, the User has the right to delete at any time the link between his Customer Account and his Facebook or Google account.

 

The creation of a Customer Account for the purchase of Products on the Site is exclusively reserved for persons, natural or legal, legally capable of entering into a contract.

 

When creating the Customer Account, each Customer agrees to provide accurate and up-to-date information.

 

 

  • Deletion of Customer Account

 

A User may at any time and at their discretion, request the closure of their Customer Account with Maison Afro.

 

A Client account will be suspended and/or deleted if Maison Afro notices or is notified of:

 

  • Fraudulent use of the Site, including but not limited to fraud, misrepresentation, fraudulent use of bank details, identity theft;

  • Behavior that does not respect the rules of good conduct set out in the article “Rules of good conduct to be respected”

 

 

  • Responsibility of Maison Afro

 

The comments made on the Maison Afro website are not contractual.

 

Maison Afro cannot be held liable in the following cases:

 

  • Failure, breakdown, difficulty or interruption of operation, preventing access to the Site or to one of its functionalities;

 

  • Loss of data or information stored by Site Users. Users are responsible for taking all necessary precautions to keep the data and information they put online under their sole responsibility;

 

  • In the event of direct or indirect damage caused to the User, whatever its nature and resulting from the access, management or use of the Site;

 

  • Abnormal or illicit use of the Site by one of its Users;

 

  • For the publication of content in the free spaces for comments, the User assumes full editorial responsibility for the content he publishes on the Site. Maison Afro will make its best efforts to promptly remove any manifestly illegal content that is brought to its attention.

 

The connection equipment to the Users' Site remains under their full responsibility. The latter undertake to take the appropriate measures to protect their equipment and their data, in particular from viral attacks via the Internet.

 

Maison Afro is not liable for damage caused by Users to themselves, to third parties and/or to their equipment as a result of their connection to or use of the Site.

 

 

  • Methods of payment via the Site

 

Maison Afro provides Users with a secure payment system, by credit card, bank transfer and PayPal. Credit card details are encrypted and never transmitted unencrypted on the Site.

 

 

  • Link to other websites

 

The Site may contain hypertext links redirecting the User to sites operated by third parties and put online by other Users if necessary.

 

Maison Afro has no control over the destination of these hypertext links. These sites are not published by Maison Afro, which cannot be held responsible for the access, content or use of these sites by the Users of the Site. The posting of hypertext links by Users is their sole responsibility.

 

These sites are not published by Maison Afro, which cannot be held responsible for the content published on them or for any damage resulting from browsing the sites by the User.

 

 

  • General provisions

 

These T&Cs may be subject to changes depending on the evolution of the regulations. Any modification will take effect from the online publication of new T&Cs replacing these.

 

The invalidity of one or more clauses hereof shall in no case lead to the invalidity of the General Conditions of Use in their entirety.

 

  • Applicable law

 

These General Conditions of Use are governed by French law and are subject to the jurisdiction of the French courts, subject to a specific attribution of jurisdiction resulting from a text of law or regulation.  

  In case of free comments area, it is strongly advised to use a filtering tool for two reasons:

  • The data processed must be adequate, relevant and not excessive

  • The processing of sensitive data is prohibited (with exceptions)

  • Compliance options:

  1. The use of moderators carrying out regular audits

  2. Automatic detection tools

  3. Comment extraction tools

  You can define banned word lists to make monitoring more efficient.
